WHAT IS EB-3 PROGRAM ?

The EB-3 program was approved by the U.S. government in 1990, allowing U.S. companies to hire foreign workers when the local workforce is insufficient to meet demand. To qualify, employers must provide evidence of labor shortages and demonstrate financial capability to pay workers.

Foreign workers can settle and work in the U.S. upon receiving a job offer from an employer, leading to obtaining a green card and becoming a lawful permanent resident.

Employer Requirements for EB-3 Sponsorship

Permanent Full-Time Job Offer

Employers must offer a permanent, full-time position to the foreign worker. This means the job cannot be temporary or part-time; it must be a stable, long-term role.

Labor Certification

Employers must obtain a Labor Certification from the U.S. Department of Labor, which involves obtaining a prevailing wage determination, undergoing labor market testing (labor certification process), and filing the PERM Labor Certification (Form 9089). This document confirms that there are no available or qualified U.S. workers for the position, ensuring that hiring a foreign worker will not negatively impact opportunities for domestic workers.

Ability to Pay

Employers must demonstrate their financial ability to pay the wage offered to the foreign worker by providing federal income tax return, audited financial statement, or annual report,…. This requirement is to ensure that the company is financially stable enough to sustain the employment.

Conducting Business in the U.S.

Employers must be actively conducting business within the United States and have a physical place or facility where the employee will work.

Can I get refund if my aplication gets refused?

Until now, the refusal rate of our cases is close to Zero. But please rest assured that you’ll get refunds from us if your case is rejected. However, the government fees are not refundable.

Can I leave my job once i get my green card?

Under this program, a joint application is filed between the employer and employee with the Department of Labor. In the event the employee fails to fulfill the job duties (i.e. suddenly leave the job) there is a possibility that the employer can file a complaint with the Department of Labor which may result in the termination of his/her Green Card. It is recommended that you stay with the employer for at least one year to avoid any issues such as this.

Will I arrive in the U.S with my green card?

The Green Card can only be ordered upon arrival in the U.S. In the meantime, the visa is endorsed and serves as a Permanent Residency document until the actual card arrives. This can be used for employment, opening bank accounts, etc.

Wil I be eligible to apply for U.S citizenship under this program?

As a Green Card holder, you will be able to apply for U.S. Citizenship and get the passport. Below are the requirements you must fulfill:

Be at least 18 years old at the time of filing Form N-400, Application for Naturalization.
Be a permanent resident (have a “Green Card”) for at least 5 years.
Show that you have lived for at least 3 months in the state or USCIS district where you apply.
Demonstrate continuous residence in the United States for at least 5 years immediately preceding the date of filing Form N-400.
Show that you have been physically present in the United States for at least 30 months out of the 5 years immediately preceding the date of filing Form N-400.
Be able to read, write, and speak basic English.
Have a basic understanding of U.S. history and government (civics).
Be a person of good moral character.
Demonstrate an attachment to the principles and ideals of the U.S. Constitution.
